By using this website ("Service") you are agreeing to be bound by the following terms and conditions ("Terms of Service") with LDriver - ABN 58 402 482 373.

Account Terms This page contains the most current version of the Terms of Service. You agree that LDriver can send you booking reminders, relevant information and other marketing via phone, SMS and/or email. You can opt out of any marketing. You are responsible for maintaining the security of your account and password. LDriver cannot and will not be liable for any loss or damage from your failure to comply with this security obligation. By purchasing from LDriver, you agree not to initiate any credit card chargeback, or dispute any payment made for services, products, digital goods, Vouchers or gift cards purchased, except in cases of proven fraud or unauthorized transactions. All disputes must be resolved directly with LDriver. You must not post or submit false information to the Service. You must not use the Service for any illegal or unauthorised purpose. You must not use this Service to violate any laws in your jurisdiction, including but not limited to copyright laws. You are responsible for all activity that occurs from your account. Accounts registered by "bots" or other automated methods are not permitted and will be removed. LDriver has the right to suspend or terminate your account, refuse any current or future use of the Service, or any other LDriver service, for any reason. Violation of any of the terms or general conditions may result in the termination of your Account.

Cancellation Rates & Trainer Rights Less than 24 hours notice before the booking will forfeit the full booking fee. A cancellation does not automatically refund payment of products or services. Any amount not subject to the cancellation fee, is credited towards your account balance at LDriver. Trainer Cancellation Rights: LDriver and its trainers reserve the right to cancel or reschedule any lesson or session at any time if circumstances arise (e.g., illness, technical failure, safety concerns). We also reserve the right to cancel or postpone a test or lesson if the trainer assesses that the student's preparation is not yet ready or safe. In such cases, we will discuss rescheduling or credit options directly with you.

Refund Policy & Consumer Guarantees

Change of Mind: We are not required to provide a refund if you simply change your mind about the service or if you find a cheaper service elsewhere.

Major Failures: You are entitled to cancel your service and receive a refund for any unconsumed services if the service has a major problem. A major problem is defined as when the service:

• Creates an unsafe situation;

• Is substantially unfit for its common purpose and cannot be easily fixed within a reasonable time;

• Does not meet the specific purpose you asked for and cannot be easily rectified within a reasonable time; or

• Has a problem that would have stopped a reasonable person from purchasing the service if they had known about it.

If you choose to continue with the service despite a major problem, you are entitled to compensation for the difference in value between the service provided and the price paid.

Minor Failures: If the problem is not major, we will fix it within a reasonable time. If it is not fixed within this time, you can choose to have someone else fix the problem and recover all reasonable costs from us. If the problem cannot be fixed, we view it as a major problem.

Proof of Purchase: Please keep proof of your agreement and payment (e.g., your invoice, email confirmation, or quote) as we may require it to process any request.

Modifications to Services and Prices LDriver reserves the right at any time and from time to time to modify or discontinue, temporarily or permanently, the Service (or any part thereof) with or without notice. Prices of all Services are subject to change with or without notice. LDriver shall not be liable to you or to any third party for any modification, price change, suspension or discontinuance of the Service.

Vouchers Vouchers are non-refundable and cannot be redeemed for cash. Unused vouchers cannot be transferred between clients.

Fees Credit card security is implemented using secure SSL encryption on all transactions and processed using a secure, trusted, PCI compliant payment gateway and used by LDriver for payment processing. All fees and transactions are in Australian Dollars.

General Conditions Your use of this website is at your sole risk. The website is provided on an "as is" and "as available" basis. You agree not to reproduce, duplicate, copy, sell, resell or exploit any portion of the website, use of the website, or access to the website without the express written permission by LDriver. Verbal, physical, written or other abuse (including threats of abuse or retribution) of any LDriver customer, employee, member, trainer, officer or external contractor will result in immediate account termination. You must not transmit any worms or viruses or any code of a destructive nature. You understand that LDriver uses third party vendors and hosting partners to provide the necessary hardware, software, networking, storage, and related technology required to run. LDriver does not warrant that (i) the website will meet your specific requirements, (ii) the website will be uninterrupted, timely, secure, or error-free, (iii) the results that may be obtained from the use of the website will be accurate or reliable, (iv) the quality of any products, websites, information, or other material purchased or obtained by you through the website will meet your expectations, and (v) any errors in the website will be corrected. You expressly understand and agree that LDriver shall not be liable for any direct, indirect, incidental, special, consequential or exemplary damages, including but not limited to, damages for loss of profits, goodwill, use, data or other intangible losses (even if LDriver has been advised of the possibility of such damages), resulting from: (i) the use or the inability to use the website; (ii) the cost of procurement of substitute goods and services resulting from any goods, data, information or services purchased or obtained or messages received or transactions entered into through or from the website; (iii) unauthorised access to or alteration of your transmissions or data; (iv) statements or conduct of any third party on the website; (v) or any other matter relating to the website. The failure of LDriver to exercise or enforce any right or provision of the Terms of website shall not constitute a waiver of such right or provision.

Live Session Protocols Single Participant Only: All private sessions are strictly one-on-one. The booking fee covers one (1) student only. You may not have other individuals (friends, family, or other drivers) sit in on the session to "share" the advice. If unauthorized participants are present, LDriver reserves the right to terminate the session immediately without refund. No Recording: To protect our intellectual property and the privacy of the session, you are strictly prohibited from recording (audio or video) any portion of the live video calls. Screen capturing or external recording devices are not permitted.

Test Routes & Scenarios We do not provide test routes as we do not know them. We strategize scenarios you might encounter in the test to help you prepare, but we do not guarantee that you will encounter these specific scenarios. You might not encounter such scenarios at all. Our goal is to prepare you for any traffic situation, not a specific route.

Service Scope & No Guarantees We provide the strategy; you provide the execution. LDriver does not and cannot guarantee that you will pass your practical driving test. Passing is dependent on your performance on the day, traffic conditions, and the assessment of the Government Testing Officer. Our "Practice Checklists," "Audits," and online sessions are educational tools only. Purchasing or using them does not automatically ensure you are a safe driver or that you will pass.

Physical Practice & Liability Disclaimer Unless explicitly stated otherwise (e.g., for specific pre-departure practicals), our services are advisory and conducted online. If you choose to practice driving based on our advice—whether alone, with a friend, or with a third-party driving school—you do so entirely at your own risk. LDriver is not liable for any traffic fines, vehicle damage, personal injury, or death that occurs while you are driving, practicing, or taking your test. We are educators, not insurers. If we recommend or you choose to book lessons with a local driving school to polish your skills, your contract is with that school, not us. We are not responsible for their conduct, vehicle safety, or teaching quality.

Advice vs. Legal Reality Any advice regarding the number of practice hours you might need is an estimate only based on average student performance. Every student learns differently, and we are not liable if you require more lessons than anticipated. LDriver provides education on driving skills only. We are not migration agents. It is your sole responsibility to ensure you are legally allowed to drive in Australia on your current visa and that you meet all government licensing requirements.

Privacy & Data Protection

1. What We Collect: We collect your personal information (name, area\location\state you live in, email, phone number, payment details, and driver licence history) strictly for the purpose of providing our services and processing bookings. 2. How We Use It: We use your data to:

• Process your payments (via secure third-party gateways like Stripe/PayPal).

• Send you booking confirmations, reminders, and strategy materials.

• Market our services to you (which you can opt-out of at any time). 3. Third Parties: We do not sell your data. We only share it with trusted third-party providers required to run our business (e.g., website hosting, email services, and payment processors). 4. Cookies & Tracking: Our website uses cookies and tracking pixels (such as the Google Tag and Facebook Pixel) to improve your experience and show you relevant advertisements. By using our site, you consent to this tracking. 5. Security: While we use industry-standard encryption to protect your data, no method of transmission over the internet is 100% secure. You acknowledge that you provide your personal information at your own risk.
